Freehold vs leasehold property in Thailand

Understand what freehold and leasehold describe, what they do not guarantee and which documents matter in a Phuket purchase.

Short answer

Freehold generally describes ownership registered without a lease term; leasehold describes a contractual and registrable right to use property for a defined period. The label alone is not enough: buyers must inspect the underlying title, registered term, renewal language, transfer rights and the legal identity of the asset being acquired.

Freehold can refer to a condominium unit, land or building—do not treat them as interchangeable

A promised renewal is not the same as a presently registered lease term

Sale, inheritance, subletting and mortgage rights depend on documents

The counterparty’s title and authority must be verified

Why the labels cause confusion

Property marketing may use “freehold” or “leasehold” without clearly stating whether the subject is a condominium unit, land, a building, shares or a contractual right. Ask for the title document and proposed registration—not a brochure summary.

Questions for any lease

An independent lawyer should confirm the registrable term, registration status, rent and prepayment provisions, transfer and subletting rights, succession, default remedies, taxes and what happens to buildings or improvements when the lease ends.

  • Who owns the land and can they grant the lease?
  • What term will actually be registered?
  • Are renewals obligations, options or marketing expectations?
  • Can the lease be assigned or inherited?
  • What events allow termination?

Decision principle

Choose the structure only after matching it to your time horizon, control requirements, resale plan and risk tolerance. A lower headline price does not necessarily compensate for weak transferability, unclear renewal rights or a problematic lessor.

Frequently asked questions

Is leasehold ownership the same as owning the land?

No. A lease is a time-limited right governed by the registered agreement and applicable law; it is not land ownership.

Does a 30+30+30 advertisement guarantee 90 years?

Do not assume so. The presently registered term and the legal enforceability of future renewal language require independent review.

Is foreign freehold always better?

Not automatically. It may offer stronger ownership characteristics for a qualifying condominium, but building quality, management, costs and resale demand still matter.
