Selling or inheriting Phuket property: plan the exit before buying

The records, transfer rights, taxes, lease provisions and succession questions foreign buyers should examine at the start.

Short answer

Before buying, model how the property can be resold, assigned or inherited under the proposed ownership structure. Check transfer restrictions, remaining lease term, foreign-quota implications, management approvals, taxes and fees, original incoming-funds evidence, probate planning and who can act if the owner is abroad or dies. A structure that works for occupancy may still create a difficult exit.

Resale rights depend on the asset and documents

Keep the original money-transfer and registration evidence

Lease assignment and inheritance require explicit review

Succession planning should match Thai and home-country arrangements

Underwrite the future buyer

Ask who is likely to buy the asset later and which rights can be transferred. A foreign-freehold condominium, a remaining lease term, a building interest and shares in a company attract different buyers, documents and risks.

Read the transfer restrictions now

Review consent rights, transfer fees, right of first refusal, rental-program obligations, renovation rules, company liabilities and any developer or manager approval. For leasehold, check assignment, succession, early termination and what happens to improvements at the end of the term.

  • Can the interest be sold or assigned?
  • Who must consent and may they charge a fee?
  • What term remains for the next buyer?
  • Which liabilities pass with the structure?

Preserve the evidence a future sale may need

Keep original registered documents, receipts, contracts, foreign-currency evidence, common-fee certificates, permits, warranties, renovation approvals and tax records. Missing originals can slow or complicate a later transfer.

Coordinate inheritance advice

A Thai will or succession plan may be useful, but it must be coordinated with the buyer's nationality, domicile, family arrangements and the exact Thai asset. The heir's eligibility and the process for recognizing authority should be reviewed before completion, not after a death.

Frequently asked questions

Can a foreigner inherit a Phuket condominium?

Inheritance and continued ownership can depend on the heir, foreign quota and statutory conditions. Obtain advice for the exact unit and heir.

Why keep the original bank-transfer documents?

They may help prove the source of funds and support registration or repatriation when the property is later sold.

Is leasehold easy to resell?

Marketability depends on the remaining registered term, transfer clauses, lessor, price and buyer confidence in the documents.
